The Van Rensselaer Land Dispute

There was a controversy between Philip Schuyler* and land owners/tenants, which may have included my ancestor, Edward Richmond. The dispute came to my attention while searching for Edward Richmond in Claverack; Richmond's name surfaced in the a book about the law practice of Alexander Hamilton.

The General's [Schuyler's*] arrangements evidently did not end all these difficulties; in 1794, for example, he invoked the law in the circuit court for Columbia County to evict a number of tenants and to sell about twelve hundred acres of their farms.

From Laws of the State of New York...:

... who are in possession of land in the town of Hillsdale in the county of Columbia of the other part relative to the right and title to the said lands so possessed and which are claimed by the said parties of the first part by virtue of the aforesaid patent... . This concerned property of John Van Rensselaer and heirs; Alexander Hamilton and his wife, Elizabeth (Schuyler) Hamilton (a Van Rensselaer granddaughter) were among those mentioned as the parties of the first part.

The Hamilton papers stated that the "those individuals (parties of the 2nd part) were charged with occupying his (Van Rensselaer's) without acknowledging themselves as tenants and without accepting leases." Although Edward Richmond was not named in the original lawsuit, Charles Truesdell was. Truesdell was named along with Richmond and two others in writs to right in the Hamilton papers. I think that it involved the same controversy.

Apparently the land disputes in Hillsdale were so convoluted that the New York legislature appointed commissioners to sort them out.

What Is A Tack In Scotland's Records?

Tacks
A tack is a similar deed to the modern lease, and is a contract between a proprietor and a tenant (or 'tacksman') in which the tacksman could enjoy possession of the proprietor's land for a certain time on payment of a set rent. Indeed there are also leases to be found in the register of deeds. Only a tiny proportion of the many thousands of tacks that once existed were ever registered, however, and usually only if there was a dispute about the terms. In practice, if you are looking for a particular tack or lease, there is more likelihood of finding it among the estate papers of the landowner concerned.

A transcription from The Binns Papers illustrates a "Tack":

TACK of the small or vicar's teinds of Bynnis, etc., by Mr. William Powrie, minister of Abercorn, to the said Thomas Dalyell and his spouse, for the grantee's lifetime and for three years after his decease; paying therefor 3 1/2 marks yearly. Done at Bynnis, 21 December 1649. Witnesses, Henry Jamissone, servant to Lady Midhop*, James Mowat and Henry Stobie. (Signed) "Mr. William Powrie, parson and minister of Abercorn," and the witnesses.

What is a sasine and what information does it contain? An instrument of sasine (pronounced 'say-zin') is a legal document that records the transfer of ownership (usually a sale or an inheritance) of a piece of land or of a building.

How many people had sasines? Very few. This record is essentially about the 'haves' of Scottish society rather than the 'have nots'.

An example of an Instrument of Sasine was found in a transcription of The Binns Papers (Binns was the seat of the Dalyell family in Scotland):

Shawnee captive George Ash, who later in life adapted back to white society, was mentioned in the National Land System under "Special Grants of Land." "His was the last Indian Grant to receive favorable treatment from Congress."

The National Land System, 1785-1820...:

...[an] early visitor [in Jefferson Co., Indiana] was probably George Ash, kidnapped in Nelson Co., Ky., and raised as an Indian. The Indians gave him a land grant which was not recognized by the Greenville Treaty of 1795. However, Congress gave him the right to claim 640 acres.

George Ash patented the first land in Jefferson Co.--435.62 acres in Section 17 Twp. 3N Range 12E and Section 16, along with fractional section 21 on April 1808. Robert McKay of Shenandoah Co., Va., patented the same land on Oct. 19, 1808. [Source]

One of the early contracts for surveys in Michigan Territory was given to Benjamin Hough on April 28, 1815 for the survey of a true meridian line northward from Fort Defiance, Ohio.

Not sure about Deed H-303. Eleanor E. McKenzie was Michael and Nancy Roark's daughter. Eleanor's oldest "McKenzie" daughter is Mary Grant McKenzie, but she was supposed to have been born on November 20, 1864, and the date on the deed is March 9, 1864. How was she listed on the deed before she was born? Was she actually born in 1863? Was the date wrong on the deed? Did I copy it incorrectly? Eleanor did have a daughter, Elizabeth Andrews, from her second marriage. Was Elizabeth mistakenly identified as a McKenzie on the deed?

"The last operators [in the salt producing lands] were Joseph Castle... . Several years later with Castle and Temple as sole owners, using other efficiencies and coal instead of wood as fuel, production reached 500 bushels in 24 hours. Until 1870 their 4 and 6 mule teams were a common sight on the Shawneetown road as they hauled salt. By 1873 overproduction and the panic with the resultant low prices, the end came to an industry which had furnished much of a new state's revenue.... ."

My John Johnson wasn't the only person of that name in Saline County, Illinois, in the 1860 time frame. There was another John Johnson, born in 1800 in Pennsylvania, with wife Eleanor, living in a different area, S S T 7 R 6 E, on the 1860 census.

On the 1860 census, it was confirmed that it was my John Johnson, born in Georgia in 1793, and his wife, Mary (Greer) Johnson, who were living on the property sold to James Johnson (presumably their son, who was also my ancestor) on Deed H-160; the census stated that my Johnsons were living at T 9 R 6 E (Twp. 9 Range 6 East).

I was looking for the Ewen Cameron/Bridget Higgins family in Land records of Kent County, ca. 1789-1954, index, ca. 1797-1957 group, specifically in this microfilm: Chatham Gore, FHL Film # 161583. [Part of Above cross-posted]. No Ewen and Bridget, but I did find a deed of interest (see below).

This site mentioned a marriage between Elizabeth Young, daughter of George and Mary (Hunter) Young, and Philip Terryberry. The Hunters were Loyalists from North Carolina.

Philip appears to be Phillip Flock (Flaugh) Terryberry, born in Canada, who died in Bourbon Co., Kansas, as did Elizabeth Terryberry.

Terryberrys married relatives of my [blog author's] relatives. Nora Adelia Teeter, daughter of Alfred and Susanna (Terryberry) Teeter, married Holden Godden. Holden was the son of Job and Caroline (Howard) Godden. Caroline Howard's sister, Melissa, married David Terryberry. Caroline and Melissa's sister, Ann, married David Kennedy; Ann Howard and David Kennedy are my 3rd great grandparents.

Philip F. Terryberry, Susannah Terryberry and David Terryberry are all found in the Durrenberger (Terryberry) database here.

After searching the Defiance County, Ohio, deeds recently [the Duncan Cameron family was living there when the 1870 census was taken] with negative results, I looked in my notes for some Roscommon Co., Michigan, deed extracts for the Cameron family. Duncan & Ellen Cameron were in Roscommon County, Michigan, when the 1880 census was taken.

"In memory of Thomas Macklem, fifth son of James and Lydia Macklem, born at Chippawa, 1817, died at Magnolia, East Florida, 1859." On the other side, "James Cummings, eldest child of Thomas C. and Caroline Macklem. Drowned in the Niagara river at Clark Hill, and whose body unhappily was not recovered. His mother, thus denied the consolation of laying it near his father, has caused this inscription to be placed here to commemorate his birth, 1852, and his melancholy death, May 6th. 1860."

When the 1860 census was taken, Eleanor was then Eleanor (Roark) Patillo Andrews (Anders in the census), widow of David Andrews. Living next to her was Starling Anders (b. VA), age 48. On the other side was a District #2 schoolhouse and then Henry Reynolds in T9R9E in Gallatin County, Illinois.

Some BACKUS entries were found in the O-Z alpha surname (Grantor) deed index of Livingston County, New York. So without viewing the index containing the "B"'s, I still found entries for my John Backus and his son, Clinton T. Backus. John Backus's daughter, Cynthia (Backus) Richardson was also found, although not a bonus since she was in the "R"s.

Jim's great-grandfather was John Gottlieb Palm, born in 1829 in Ebingen, Wurttemberg, Germany. He primarily went by Gottlieb; he had a brother named John Gottfried Palm and a brother named John Lewis Palm. His first wife was Mary Bartholt. Mary (b. ca 1831) had a daughter, Mary, born about 1847 (who used the surname Palm), before she married J. Gottlieb Palm. Mary & Gottlieb Palm's children together were Gottlieb, Lewis, Lillie, Charles, Emma, Ida Ottillie and Caroline Palm.

J. G. Palm who was living in Lima, Allen County, Ohio, in 1860 was a tobbaconist (sp) born in 1818 (age 42) in Pennsylvania. Also in the census with J. G. Palm was wife Mary, age 39, born in Wurtemburg, with children Mary, age 13, born in Ohio, G., male, age 10, S. or L., age 8, female, Sila, female, age 6, and A., female, age 2. The age and birthplace do not correspond to what is known about Jim's ancestor, J. Gottlieb Palm, although the names/initials are close enough to warrant consideration.

In 1850 it appeared as though J. Gottlieb Palm was living with his wife, Mary, and possibly his father, Jacob, in Circleville, Pickaway Co., Ohio, where the Palms concentrated after moving to the United States. Mary's daughter Mary is not in the household. The couple was listed as "married within the year" on the census; Mary Bartholt and Gottlieb Palm were married in December 1849.

There was also a Gottlieb Palm family living in Crawford Co., Ohio, in 1850. Did they move from Circleville, or was this another Palm family, or.....?

In 1880 Gottlieb Palm, age 50, is living with his brother as a widower and retired grocer (his obituary stated he was a grocer/butcher). Actually Gottlieb returned to Germany after his first wife died and married a cousin, Fannie Palm (Jim's great-grandmother) in 1870. A marriage record between Gottlieb Palm and Fannie Palm was found in Allen County, Ohio (which is why I thought Jim's ancestor, Gottlieb, lived in Allen Co). Was there another Gottlieb/Fanny marriage? Hightly unlikely, but.... . Most of their children were born in Germany from ca 1872 to 1881 (perhaps Gottlieb came back alone and that was why he was living with his brother as a widower (did someone forget that he remarried?).

If there was another J. G. Palm and family in Allen County in 1860, where were they in 1870, 1880, etc.?

JUDGE ROANE. About the year 1768 and 1769, Doctor Thomas Walker, who had a large tract of vacant land in the County of Washington, and wished to sell it out to settlers, published his price and terms therefor, in advertisements stuck up at two or three places in the Western Country. In consequence of these proposals, many persons went out and actually settled on the lands; and among *others, James Piper, Joseph Black, Christopher Acklin, Josias Gamble, Alexander Breckenbridge, and John Campbell, (who have all given depositions in this cause,) and John Huston, under whom the appellant claims.... .

The Vance vs. Walker lawsuit in the Court of Appeals.

Doctor Thomas Walker, who married 2nd Mildred (Thornton) Meriweather, widow of Nicholas Meriweather, maintained a journal (1749/50) of his travels.

Background of Dr. Walker and the Loyal Company: "Later in 1749, Peter Jefferson (father of future U.S. President Thomas Jefferson) and Joshua Fry, along with Dr. Thomas Walker of Albemarle County (1714-1794), James Maury, Thomas Meriwether (grandfather of Meriwether Lewis) and others, established the Loyal Company with the purpose of petitioning for a large grant of land west of the Allegheny Mountains." The plans of the Loyal Company and other land speculators encountered a glitch in the form of King George's Proclamation Line of 1763.

... In 1749 the Loyal Land Company was formed and given eight hundred thousand acres to be located indefinitely in the west north of 36 (degrees) 30.

The Loyal Land Company though the last to be organized was the first to begin work. In the winter of 1749 they commissioned Dr Thomas Walker of Albemarle County Virginia to explore the western country and report concerning its character. Dr Walker began his journey in March 1750 notwithstanding the bad season.

The most interesting item to me is that T. P. (Thomas P.) Richmond was the taxpayer on Dryden Township property described as NE ¼ of NE ¼ 8-6-11 40 acres in 1860; in 1861 Thomas Richmond's son-in-law, James More, was the taxpayer of record for the same property.

This source is where I found the Greer/Garrett link and has the lineage a bit different than what I have. This source has Asel Greer, b. 1756, marrying both Polly Lowe and Rebecca Neighbors. This source has the Asabel/Asa Greer, b. 1756, as the husband of Polly Lowe and Asel Greer, b. 1772 as the husband of Rebecca Neighbors (as of now, my data reflects the Asel Greer, b. 1772 and Rebecca Neighbors).

The deed above may belong to Asa Greer b. 1756.

Boiling Fork of Elk River

The most important natural resource of the early town has sadly been forgotten since it was engulfed by Tims Ford Lake. This was the Boiling Fork of Elk River. This energetic little stream bubbled up in Hawkins Cove and flowed toward Winchester, gathering fullness from other streams and turning the water wheels at Martin's, Decherd's, Handly's and Oehmig's mills and racing beneath the bluff of its own creation. As it flowed toward Little Red Mill and Winchester Springs, it furnished sites for bottling plants and bottle-making plants, and for the tanneries of Madison Porter and William Buchanan. Sometimes in a very rainy season it would wash over the bridges that spanned it, threatening their very existence.

Detroit In A 1753 Map

The author of Map maker & Indian traders indicated that he"...became interested in A&. finding the maps which first showed references to the presence of bituminous coal in various states, and the one which did this for Pennsylvania, Ohio, and possibly Kentucky was found to be the so-called "Trader's Map" in the Library of Congress. The maker of this map is shown to have been John Patten, as certainly as it can be shown without finding a signed copy of the map."

Part of the author's detective work to prove that Patten made the "Trader's Map" compared spelling in Pattin's writings and spelling in the "so-called" Trader's Map:

Part of a 1753 "Patten" map that shows Detroit north of Lake St. Clair, rather than in its proper position which is south of Lake St. Clair. That's one of the identifying aspects that the author of Map Maker & Indian Traders found in favor of it being Patten's map.

Beaubien Street - Named for the Beaubien family and their farm, which was bordered by Beaubien Street. Mary Bailey of the Detroit News, writes, "Beaubien and St. Antoine originated from the two Beaubien brothers, Lambert and Antoine, each of whom received half of the family farm after the death of their father, Jean Baptiste Beaubien, one of the first white settlers on the river, opposite Fort Dearborn. Lambert was a colonel in the First Regiment of Detroit's militia. He fought in the War of 1812. Antoine chose to name his property after his patron saint, St. Antoine. Antoine was a lieutenant colonel in the Michigan Territorial Militia. He donated a chunk of his land for the Sacred Heart Academy, once located at the corner of Jefferson and St. Antoine."

Detroit Police Headquarters (my former place of employment) is located at 1300 Beaubien Street.

Well this is weird. One of the cases cited in a Beaubien land dispute in Detroit was the estate of Anthony Bledsoe who was killed in 1788 by Indians in Tennessee. My November 6, 2010, blog in "Detour Through History" profiled Anthony Bledsoe and events surrounding his estate.
